Indian cyber agency gives 3 months breathing space to VPN providers

The Indian Computer Emergency Response Team (CERT-In) on Tuesday approved an extension to meet its cyber security standards. It is now the 25th of September.

MeitY, according to a statement issued by the Ministry of Electronics and Information Technology, gave almost three months of relief from the 60-day deadline of May 28.

According to the ministry, the extension was granted as MSMEs, VPS, VPN and cloud service providers requested time to “build the capabilities” necessary to comply with the guidelines, which Cert-In released on April 28.

The requirement for data centers, VPS, VPN and cloud service providers to register and maintain validated names, addresses and contact numbers of subscribers and customers will come into effect from September 25, the Ministry said.

The extension is likely to give respite to many companies, particularly SMEs, who said they did not have the capacity or bandwidth to adhere to Cert-In standards in such a short period of time.

While some SMEs and companies have told the ministry that they would comply with the regulations but it would take more time, VPN service providers like ExpressVPN, Surfshark, NordVPN and others had earlier said that they would stop their services in India by June 28.

Minister of State for Electronics and Information Technology Rajeev Chandrasekhar stated in a press conference on May 18 that VPN service providers that do not comply with Cert-In guidelines are “free to exit India”.

The IT ministry met stakeholders on June 10, including VPSs, SMEs, VPNs and other cloud service providers to discuss their position and answer all their queries.

The meeting was attended by around 25 executives from VPN service providers, technology companies and policy groups and other experts. ET reported that the IT ministry had indicated that they would not comply with the six-hour deadline for reporting cyber security incidents.

The IT ministry, however, informed the stakeholders that for smaller companies and SMEs, it may provide relaxation on a case-by-case basis after examining their applications.

Cert-In’s April 28 guidelines required all companies, intermediaries, data centers and government agencies to disclose all data breaches to the government within six hours of the organization becoming aware of the breach.

The guidelines also specified that VPN service providers must store all data collected in accordance with customer identification rules and hand it over to the government whenever necessary.
